Auction Rules

1. Trustee

BikiniMaster.com acts as the trustee of the seller. Unless otherwise agreed, when the auction item is auctioned (meaning that the highest bid price of the auction item at the end of the auction is equal to or higher than the reserve price of the auction item, that is, the auction is confirmed), the seller entrusts BikiniMaster.com to reach a sales agreement with the buyer.

2. Before the Auction

1. Buyers are reminded that the descriptions of auction items in the “Auction” catalog on BikiniMaster.com are for reference only. BikiniMaster.com has made every effort to provide photos of the lot in its current condition, but does not guarantee that the lot will be free of other defects and blemishes. Therefore, the auction items are only auctioned “as is” (that is, including all defects, defects and incompleteness). BikiniMaster.com does not undertake any guarantee or defect guarantee responsibility for any auction items. Buyers should carefully review the relevant information of the auction items before participating in the auction.

2. Description of auction items :

These materials are for guidance only, and the absence of reference to these materials does not imply that the Lot is free from defects or modifications, nor does the reference to specific defects imply that it is free from other defects.

3. Register to Bid

1. Register :

(1) If you have not bid with BikiniMaster.com before and do not have a BikiniMaster.com account, you need to register to create a BikiniMaster.com account first, and provide any required information and fill in any necessary information. To register and bid in the online auction, you must be at least 18 years old. If you have registered for a BikiniMaster.com account, you can log in with your existing username and password, and then participate in bidding (if you have more than one account, you will need to choose which account you want to trade with).

(2) BikiniMaster.com will only ship to the address confirmed when you register in your online account, and it will be used as the address for sending and receiving physical letters. Members should go to the member center to fill in their relevant information.

4. During the Auction

4. Online Auction Process :

(1) Bids can only be submitted within the date and time specified in the sales materials for the lot.

(2) Once you place and confirm your bid amount, the bid will be submitted. You accept and agree that bids submitted in this manner are final and that you may not modify or withdraw your bid under any circumstances. We are not responsible for any errors you make in your bidding.

(3) The starting price generally starts with a low estimate or lower price, and gradually increases according to the bidding ladder (subject to what is provided by BikiniMaster.com). Bidding starts at the specified bid amount and progresses in the bidding ladder.

5. Auction Results The auction result will be considered absolute and final in all disputes. In the event of any discrepancy between any online records or information provided to you and the auction results, the auction results will prevail.

6. Cancellation BikiniMaster.com reserves the right, in its sole discretion, to withdraw any lot, either before or during the auction, and will not be liable for this.

7. Closing of auction items A countdown timer for each lot is displayed on the lot description page. All buyers should seize the time to bid early, and pay attention to the e-mail notification letter sent by the system to grasp the bidding time.

Successful bid Unless BikiniMaster.com decides to use its discretion, the highest bidder will be the winning bidder at the end of the auction, that is, the seller entrusts BikiniMaster.com to reach a sales agreement with the auctioned buyer (a sales contract has been formed between the seller and the winning bidder). The successful bidder will be notified by email of a successful bid. The winning bidder must log in to BikiniMaster.com as soon as possible after winning the bid, and obtain detailed information on the winning result through the “Checkout” button of the winning item. We will not be responsible for notifying the outcome of the auction unless you are the successful bidder. You should check back as soon as the auction closes for details on the outcome of your bids.

5. After the Auction

If the identification card is found to be counterfeit, BikiniMaster.com shall not undertake any other obligations or any guarantee responsibilities to the buyer. BikiniMaster.com reserves the right not to disclose information about the seller of the auctioned object.

2. Taxes All payments made by the bidding buyer to BikiniMaster.com are exclusive of any goods tax, service tax or other value-added tax. If there is any relevant tax, the buyer who bids is responsible for paying the tax according to the tax rate and time stipulated by the relevant laws.

Neither the seller nor BikiniMaster.com, nor any employee or agent of BikiniMaster.com, shall be liable for any error in any statement of authorship, provenance, date, age, attribution, authenticity or provenance, or any other description of any Lot, or for any defect or defect in any Lot, except in the event that this Lot or identification card is found to be a counterfeit. 7. Service Interruption Policy

(2) After the membership account is canceled, if the member violates the law or violates the contract on the BikiniMaster.com trading platform before logging out, BikiniMaster.com can still exercise the rights stipulated in this membership contract.

2. Under the following circumstances, BikiniMaster.com may immediately suspend, suspend or terminate your membership and refuse to provide your BikiniMaster.com services, and shall not be liable for any direct or indirect damages caused by the user:

(1) When a member violates the relevant provisions of this membership contract, BikiniMaster.com has the right to terminate the service provided to the member. However, if the member registers as a member of BikiniMaster.com again directly or indirectly or in the name of another person after being terminated by BikiniMaster.com, BikiniMaster.com has the right to unilaterally terminate the service to the member again;

(2) If BikiniMaster.com contacts a member through the information provided by the member, and finds that the e-mail address or telephone number filled in by the member no longer exists or can be contacted, BikiniMaster.com notifies the member of the change through other contact methods, and if the member fails to make corrections within two working days, BikiniMaster.com has the right to terminate the service provided to the member;

(3) Once BikiniMaster.com discovers that the main content of the member’s registration information is false, BikiniMaster.com has the right to terminate the service to the member at any time.

(4) When the membership contract is terminated or renewed, the member expressly refuses to accept the new service membership contract;

(5) When BikiniMaster.com believes that your actions may cause legal liability to you, members of BikiniMaster.com or BikiniMaster.com;

(6) When the software and hardware equipment related to this service are relocated, replaced, upgraded, maintained or repaired;

(7) The service is stopped or interrupted due to the actions of third parties, natural disasters, accidents or other force majeure;

(8) The service is stopped or interrupted when the traffic of members using this service exceeds the maximum amount set by the original website.

3. When BikiniMaster.com suspends, interrupts, or terminates member services due to members’ violation of laws and regulations or violations of service membership contracts, member transactions before service suspension, interruption, and termination shall be handled in accordance with the following principles:

(1) Before the service is suspended, interrupted or terminated, if the member is a seller and has provided an item uploaded by BikiniMaster.com but has not yet been sold, BikiniMaster.com has the right to delete the relevant information of the item;

(2) Before the service is suspended, interrupted or terminated, if the member is the buyer and has bid for the works for sale, but the transaction has not yet ended, BikiniMaster.com has the right to delete the bid record of the member.

8. Rights and Obligations of Members

1. Members have the right to use search, query, bid, purchase and other functions in accordance with the provisions of these auction rules and the relevant rules published on BikiniMaster.com, participate in relevant activities of BikiniMaster.com, and have the right to enjoy other relevant information services provided by BikiniMaster.com.

2. Members can report to BikiniMaster.com if they find that other members have violated the law or the auction rules.

3. Members are obliged to provide their own real information when registering, and to ensure the validity of content such as email addresses, contact numbers, and mailing addresses, and to ensure that BikiniMaster.com can contact themselves through the above contact methods. At the same time, members are also obliged to update the relevant registration information in a timely manner when the relevant information actually changes. Members promise not to register or authenticate on BikiniMaster.com with other people’s information.

4. Members should ensure that they abide by the principle of honesty and credit during the transaction process using the BikiniMaster.com platform, do not take unfair competition during the transaction process (such as fake bids), do not disturb the normal order of the website (such as hacking), and do not engage in behaviors that are not related to online transactions (such as random spam).

5. Members promise that all their behaviors when using BikiniMaster.com will abide by national laws, regulations, relevant norms of BikiniMaster.com and various social public order and good customs. If there are any legal consequences caused by violation, the member will bear all the legal responsibilities in his own name.

6. Members agree not to make commercial use of any information on BikiniMaster.com, including but not limited to using any information on BikiniMaster.com by copying, distributing, etc. without the prior written consent of BikiniMaster.com.

7. Members agree to receive emails and information from BikiniMaster.com or BikiniMaster.com partners.

8. If a member has a dispute with another member during the transaction on BikiniMaster.com, he may request BikiniMaster.com to mediate it. After being reviewed by BikiniMaster.com, BikiniMaster.com has the right to contact the parties in dispute by email or telephone to understand the situation, and notify each other of the situation learned by email or telephone.

9. If a member has a lawsuit with other members due to transactions on BikiniMaster.com, the member may request BikiniMaster.com to provide relevant information through the judicial or administrative department in accordance with legal procedures.

10. BikiniMaster.com has the right to check the registration information and transaction behavior of members, and if it finds any problems or doubts in the registration information or transaction behavior, it has the right to issue inquiries and request correction notices to members or directly delete them.

11. If it is confirmed by national effective legal documents or administrative punishment decisions that the member has violated the law, or BikiniMaster.com has sufficient factual basis to determine that the member has violated the law or the service membership contract, BikiniMaster.com has the right to publish the member’s illegal behavior on the BikiniMaster.com trading platform and its website in the form of online publication.

12. Data Usage Rights. Once you input or provide any information to BikiniMaster.com, you are deemed to have allowed BikiniMaster.com to use, modify, reproduce, publicly broadcast, modify, distribute, issue, publicly publish, and publicly transmit such information in accordance with the specifications in the Privacy Policy, and you may delegate the aforementioned rights to others, and you have no objection to this. You should also ensure that BikiniMaster.com will not infringe the intellectual property rights of any third party by using, modifying, reproducing, publicly broadcasting, converting, distributing, publishing, publicly publishing, publicly transmitting, and sublicensing such materials, otherwise BikiniMaster.com shall be liable for damages (including but not limited to litigation costs and attorney fees, etc.).

13. Due to the special nature of the network, BikiniMaster.com is unable to conduct a prior review of all member registration information, all transaction behaviors and other matters related to transactions, but if the following situations exist:

(1) Members or other third parties notify BikiniMaster.com that there may be major problems with a specific member or specific transaction;

(2) When members or other third parties report illegal or inappropriate behavior to BikiniMaster.com, BikiniMaster.com judges the relevant content based on the knowledge standards of ordinary non-professional traders, and it can be clearly believed that the content or behavior is illegal or inappropriate. BikiniMaster.com has the right to choose to retain or delete relevant information or to continue or stop providing services to members according to different situations, and to pursue relevant legal responsibilities.

9. Payment

(1) The buyer who bids is required to pay all transaction payments online within seven days after the auction. Otherwise, the representative will automatically give up the winning bid, and will be added to the blacklist, and will no longer be able to participate in bidding in the future.

(2) We only accept payment from bidders. After checkout, we cannot change the buyer’s name or change it to another name. Even if you want to export an auction item and need an export license, you must pay immediately.

(3) You must pay for the auction item in the sales currency. You must pay for any auction lot purchased on BikiniMaster.com Online Exclusives by credit card or PALPAY in your name. We only accept MasterCard, Visa’s credit cards.

(4) Payment information is directly collected and processed by third-party cash flow service providers, not by BikiniMaster.com. For details, BikiniMaster.com will not obtain or retain any credit card information. After you enter the card number and authorization code, you will be linked to the page for entering the password, or send a one-time password by SMS. If you have not obtained the password, please go to the website of the issuing bank to obtain the password. Only the issuing bank and you know the password, and this platform will not record it. If the buyer fails to pay the auction within seven days after the auction, or the seller is unwilling to sell or refuses to transfer the ownership of the auction item to the buyer after the buyer has paid all the transaction money, or any dispute arises during the auction, BikiniMaster.com shall not be liable for the buyer and seller (including taking any legal action on behalf of the buyer/seller). However, BikiniMaster.com has the right to exercise one or more of the following rights :

(1) File a lawsuit against the buyer who breached the contract, requiring the buyer to compensate for all losses suffered by BikiniMaster.com and the seller due to the breach of contract and all costs of filing the lawsuit, and to compensate BikiniMaster.com for 30% of the auction price of the auction as punitive liquidated damages;

(2) Cancel the buyer’s transaction in this or other auctions for the defaulting buyer;

(3) If the buyer fails to pay in full within seven days after the auction, BikiniMaster.com will resell the original auctioned object in public or private auctions.

(4) If the buyer fails to pay in full within seven days after the auction, BikiniMaster.com may retain the buyer’s bid for this or other auctions, and will not send it to the buyer until the “total amount payable” is paid;

(5) If the buyer in breach of the contract has any due or undue auction proceeds receivable on BikiniMaster.com, BikiniMaster.com has the right to offset the “total amount payable”, and the insufficient part can set up pledge rights or other rights for any items it has entrusted to BikiniMaster.com for safekeeping.

5. Delivery of Lot :

(1) The auctioned item will be delivered to the contractor entrusted by BikiniMaster.com within seven days after the buyer has paid in full according to the buyer’s rules for delivery to the location designated by the buyer. However, BikiniMaster.com does not assume any legal responsibility for any delivery of the auction item. If any dispute arises due to delivery, BikiniMaster.com can assist the buyer to negotiate with the contractor.

(2) If the auctioned buyer pays off the payment within seven days according to the buyer’s rules, but the goods are sent out after payment, and the auction item cannot be signed for in the end, then the relevant risks and expenses incurred by the auction item shall be borne by the buyer, and BikiniMaster.com shall not bear any legal responsibility.
